Terms and Conditions
Please read the following terms and conditions carefully before booking any services with Mold K9 Detection Services, a Florida-based provider of canine-assisted mold detection services.
1. Scope of Services
Mold K9 Detection Services offers non-invasive mold detection services using specially trained dogs and certified handlers. The inspection involves a combination of visual observation and scent-based detection techniques to identify areas with possible mold presence.
This is a non-destructive and non-sampling assessment. Mold K9 Detection Services does not remove building materials, collect physical samples, or perform laboratory analysis.
The K9 inspection is a supplemental tool in a broader mold investigation strategy and is not intended to replace environmental testing, moisture mapping, or remediation protocols.
Mold K9 Detection Services does not provide mold remediation services or issue remediation protocols or scopes of work.
2. Limitations and Disclaimers
No Guarantee of Results: While canine mold detection is highly sensitive and reliable, Mold K9 does not guarantee the complete absence or presence of mold. Factors such as airflow, material density, and location may impact scent detection.
Not Responsible for Remediation: Mold K9 Detection Services shall not be held liable for remediation decisions or costs. Clients are solely responsible for follow-up actions.
Third-Party Verification Encouraged: We recommend clients consult independent mold assessors or laboratories to verify results before taking action.
Odor Accessibility Limitation: Mold K9 Detection Service’s dogs are trained to detect the scent of actively off-gassing mold. Mold concealed within sealed structures (e.g., deep behind walls, in sealed attics) may not emit detectable odors. Additionally, mold odors located above ~10 feet may fall outside the dog’s effective detection range.
Incidental Property Contact: Mold K9 Detecton Services exercises caution during inspections; however, the client acknowledges that minor, unintentional contact with furniture or items (e.g., scratched baseboards, toppled décor) may occur and waives claims for incidental damage.
Media Use Disclaimer: Client agrees that Mold K9 Detection Services may record video or take photos during the inspection for educational or promotional purposes. No compensation shall be owed to the client for use of such content, which will not include identifiable address or personal data without express written consent.
3. Client Obligations
Animal Control: All pets must be secured or removed from the property prior to the K9 inspection. Failure to comply may result in cancellation with no refund.
Access: Client must ensure clear and safe access to all inspection areas. Blocked or restricted zones may limit the effectiveness of the inspection.
Site Safety: Clients are responsible for disclosing any known hazards on the property (e.g., exposed nails, unstable structures) and ensuring safe working conditions for Mold K9 Detection Services staff.
4. Deposits, Cancellations, and Travel
Local Appointments (Driving to Client)
A 50% of service fee non-refundable deposit is required to confirm the appointment.
Cancellations made more than 48 hours in advance may apply the deposit toward a future inspection scheduled within 90 days.
Cancellations made within 48 hours of the scheduled appointment will result in complete forfeiture of the deposit.
Non-Local Appointments (Flying to Client)
A deposit of 50% of the total estimated cost is required for out-of-area appointments requiring air travel.
This deposit is non-refundable but partially refundable if Mold K9 has not yet incurred significant costs. Direct expenses deducted may include:
Airfare or fuel
Lodging
Mileage ($0.35 per mile)
Non-refundable fees
Cancellations made less than 48 hours prior are non-refundable.
Mold K9 reserves the right to cancel or reschedule services due to weather, illness, emergencies, or other unforeseen events.
5. Confidentiality and Data Use
Mold K9 treats client data as confidential and does not disclose addresses or identifying information without written consent.
Media collected during the inspection may be used for marketing or training but will never display personal identifiers unless explicitly approved.
6. Indemnification
Client agrees to indemnify and hold harmless Mold K9 Detection Services, its employees, contractors, and agents from any claims, damages, or liabilities arising from:
The inspection process
Client-provided false or incomplete information
Failure to follow recommendations or safety protocols
7. Limitation of Liability
Mold K9 Detection Services liability for any claim, whether in contract or tort, is limited to the amount paid by the client for services rendered. No consequential or incidental damages shall be recoverable.
8. Dispute Resolution
Any disagreement arising under this agreement shall first be addressed through good-faith mediation in the state of Florida. If mediation fails, the matter shall be resolved through binding arbitration under the rules of the American Arbitration Association (AAA), with the venue in the client’s Florida county of residence or Mold K9 Detection Services principal office county. With the maximum payout of arbitration being the fee paid for the detection work.
9. Delays Due to Weather or Unforeseen Events
Mold K9 Detection Services reserves the right to reschedule services due to hazardous weather, emergencies, or any other condition that may interfere with the safety or quality of the inspection.
10. Ownership of Media
All photos, videos, and materials created during the inspection remain the exclusive property of Mold K9 Detection Services. Mold K9 Detection Services may use these materials for educational, internal training, or promotional use.
11. Entire Agreement
This document constitutes the full and final agreement between Mold K9 Detection Services and the client. No oral statements or prior understandings shall have any effect unless incorporated herein.
12. Severability
If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in effect. A waiver of one provision shall not be deemed a waiver of any other.
13. Force Majeure
Mold K9 Detection Services shall not be held liable for delays or failure to perform due to causes beyond its control, including but not limited to acts of God, labor strikes, natural disasters, power outages, illness, or government mandates.
14. Definitions “Mold K9”: Refers to the business entity providing K9 mold detection services.
“K9”: Refers to the trained dog used for scent-based mold detection.
“Client”: Refers to the individual or entity engaging Mold K9’s services.
“Inspection”: Refers to the K9-assisted mold detection procedure.
“Odor”: Refers to volatile organic compounds (VOCs) emitted by mold that are detectable by trained canines.
